Registrant Agreement

This document contains the terms and conditions for registration, transfer, and updates to domain names. These terms form part of and incorporate by reference the RightwayHost Standard Terms available at https://www.rightwayhost.co.za/terms-conditions.

All domain registration services are provided via ConnectReseller (third-party registrar) and associated Domain Name API systems. Management of domains, hosting, and related products is conducted through the RightwayHost client portal (dashboard.rightwayhost.com, provided via Upmind) and any integrated third-party billing systems. By registering a domain through RightwayHost, you acknowledge and accept the use of these third-party systems and agree to abide by their operational limitations.

1. Definitions

1.1. Administration Sites – the Registry’s official administration websites and the Registrar’s official administration websites (e.g., www.rightwayhost.co.za), including third-party management systems like ConnectReseller.
1.2. Client Portaldashboard.rightwayhost.com, provided through Upmind, where account management, billing, and product oversight occur.
1.3. Agreement – the Application together with these terms and conditions.
1.4. Applicant – the party making the application for delegation, transfer, or update of a domain name, identified as the Registrant on the Application.
1.5. Application – the request submitted by or on behalf of the Applicant for delegation, transfer, or update of a Domain Name.
1.6. Registrar – RightwayHost, acting as a reseller through ConnectReseller, a third-party accredited domain registrar, and using associated APIs for domain management.
1.7. Domain Name – any domain name registered or transferred through RightwayHost or its third-party systems (e.g., example.com, example.net, example.org).
1.8. Registry – the organization responsible for the administration of domain names, including any successors or assigns.
1.9. Personal Information – information relating to an identifiable, living, natural person.
1.10. Published Policies – specifications and policies published by the Registry, including dispute resolution policies and operational rules.
1.11. Standard Terms – RightwayHost’s standard terms and conditions found at https://www.rightwayhost.co.za/terms-conditions.

2. Applicability

2.1. These terms apply to all domain names registered, transferred, or managed through RightwayHost, whether processed via ConnectReseller, Domain Name API, or directly through RightwayHost.
2.2. Applicants agree to comply with all Published Policies, Standard Terms, and operational requirements of the Client Portal and third-party systems.
2.3. Access and use of the Client Portal, including billing and domain management, is subject to the operational limits and terms set by Upmind and other integrated systems.

3. Third-Party Systems

3.1. All domain registration, updates, transfers, and related services are conducted through ConnectReseller and associated Domain Name API systems.
3.2. Management of domains, hosting, and products is done via the Client Portal (dashboard.rightwayhost.com) and integrated third-party billing platforms.
3.3. RightwayHost and its third-party providers make no guarantees regarding uninterrupted access, data integrity, or operation of these systems. Any downtime or functional limitation shall not constitute a breach of this Agreement.

4. Fees and Refunds

4.1. All fees, billing, and payment terms are governed by the Standard Terms.
4.2. Payments are processed via the Client Portal and/or integrated third-party billing systems.
4.3. No refunds will be issued for domain registrations, transfers, or other services provided through RightwayHost, ConnectReseller, or related systems.

5. Rights to Domain Names

5.1. Domains are delegated on a first-come, first-served basis. Registration does not constitute any guarantee of legal ownership or rights to the name.
5.2. RightwayHost and the Registry provide no warranties regarding the use, legality, or functionality of the Domain Name.
5.3. The Registry and Registrar are not arbiters of disputes and are not responsible for resolving third-party claims unless required by law or Published Policies.
5.4. Applicants may be required to provide contact information to resolve disputes, and RightwayHost may disclose such information to a third party in accordance with dispute resolution procedures.

6. Applicant Duties

6.1. Applicants must provide accurate, complete, and up-to-date contact details for the Registrant, administrative, and technical contacts.
6.2. Any wilful provision of inaccurate or outdated information, or failure to respond to Registrar inquiries within fifteen (15) days, may result in suspension or cancellation of the domain registration.
6.3. Applicants licensing domain use to third parties remain responsible for ensuring contact information is accurate and timely updated.

7. Warranties and Indemnity

7.1. The Applicant warrants that:

  • All submitted information is accurate and complete;

  • They have the right to use and register the Domain Name;

  • Domain registration does not infringe any third-party rights;

  • Domains will not be used for illegal purposes (e.g., malware, phishing, counterfeiting);

  • Operational name servers are in place and capable of responding to queries.

7.2. The Applicant agrees to indemnify and hold harmless RightwayHost, the Registry, and their affiliates against any claim, loss, or liability arising from breach of warranties or use of the Domain Name.

8. Suspension, Cancellation, and Transfer

8.1. RightwayHost and the Registry may withdraw, suspend, or transfer domain names under the following circumstances:

  • Non-payment of fees;

  • Breach of warranties or obligations;

  • Legal or regulatory orders;

  • Dispute resolution decisions;

  • Operational or Registry errors.

8.2. Applicants consent to domain deletion, suspension, or transfer under Published Policies or as required to resolve disputes.

9. Personal Information

9.1. Personal Information is used for legitimate purposes, including domain registration, billing, and operation of the Client Portal.
9.2. The Applicant consents to the processing and transmission of Personal Information to third parties, including ConnectReseller, Upmind, and other service providers, both locally and internationally.
9.3. Withdrawal of consent may result in suspension or cancellation of domain registration.

10. Exemption and Indemnity of the Registry

10.1. The Registry and its affiliates will not be liable for any direct or indirect damages arising from domain registration or use.
10.2. Applicants indemnify and hold the Registry harmless against all claims, damages, or costs related to their domain registration.

11. General

11.1. Disputes are subject to the jurisdiction of South African courts.
11.2. This Agreement is governed by the laws of the Republic of South Africa.
11.3. RightwayHost may amend this Agreement as reasonably required for administration or compliance purposes.
11.4. Applicants are responsible for monitoring amendments and agreeing to them within 30 days of publication in the Client Portal.
11.5. Any invalid or unenforceable provisions shall not affect the remainder of the Agreement.

12. Transfer of Domain Ownership

12.1. The Registrant of record retains control over the domain name and must ensure any transferee agrees in writing to be bound by this Agreement.
12.2. RightwayHost is authorized to act as the Designated Agent to approve a Change of Registrant on behalf of the Registrant, in accordance with applicable transfer policies.
